European Union Law

All the lawyers at FratiniVergano, while trained in their respective national laws, specialise in EU law.

We advise on the institutional aspects of EU law (powers and competences of the EU institutions and right of individuals vis-à-vis the institutions) as well as on the fundamental principles of the internal market (free movement of goods, services, capital and workers, freedom of establishment).

In particular, we assist companies and individuals to take full benefit from the internal market and to enforce against domestic and foreign administrations the general principles of non discrimination and transparency, as well as the other specific principles forming the acquis communautaire.

We advise and represent clients in administrative proceedings before the EU Institutions and in litigation before the EU Courts in Luxembourg.

Our lawyers have gained a significant experience in sector-specific regulation developed by the EU Institutions: we provide guidance and assistance in relation to the development of legal frameworks applicable to network industries, audiovisual IPRs, financial services, regulated professions, agriculture and food, certification and definition of technical standards.

EU Internal Market
(e-communications, postal services, energy, transport, regulated professions, gambling, IPRs, Directive 98/34/EC)

FratiniVergano has an integrated competition and regulatory department. The firm provides advice on a daily basis and represents clients before the relevant EU and national authorities and courts.

Our experience in this field includes consultancy and interest representation in the EU decision making process; we also assist and advise administrations and individuals on specific issues related to the implementation in Member States.

Our goal is to provide guidance and strategic advice on the constantly evolving EU legal framework in various sectors of business law, including regulated professions, public procurement, intellectual and industrial property, services, gambling, postal services and financial services.

Our lawyers have been dealing with the concrete regulatory and competition issues faced by new entrants in national telecommunications markets, the setting up and the application of new EU rules in the fields of communications, data protection, Internet/e-commerce, entertainment services, postal services, regulatory matters related to ports, maritime, road and intermodal transport.

Our expertise also covers notifications of technical regulations under Directive 98/34/EC and advice on EU funding instruments for R&D (FP7, CIP, AAL) under the new EU rules for 2007-13.

EU Competition Law

The Competition Law team of FratiniVergano is a highly motivated group of lawyers with a thorough experience in the field of EU and national competition laws. We assist clients in corporate transactions, infringement proceedings and State aid cases and represent applicants, complainants and defendants in high profile cases before the European Commission and the European Courts.

Our expertise covers the whole spectrum of EU and competition issues: antitrust, merger control, State aid, public services and services of general economic interest; antitrust/State aid compliance and litigation, i.e. assisting and representing clients in judicial and administrative proceedings before the EU and national courts, the Commission and the national competition authorities.

We have broad regulatory experience and advise governments and regulatory bodies on State aid issues. Lawyers in the firm have also trained and assisted national administrations in drafting State aid scheme projects, particularly those aiming at promoting the use of sustainable transport modes.

Litigation

FratiniVergano assists and represents its clients before all EU jurisdictions: the Court of Justice, the Court of First Instance and the Civil Service Tribunal. We also provide advice in national court proceedings in all cases where an EU or an international law issue becomes relevant.

Training and educational programmes

FratiniVergano offers education and training for young lawyers and hosts international graduates within the framework of the Leonardo Da Vinci Programme (EC Lifelong Learning Programme) and other mobility projects. We team up with several leading Universities and Master’s degree programmes, namely with the University of Rome (Tor Vergata and Roma 3), the Université Libre de Bruxelles (ULB), the University Alma Mater Studiorum of Bologna, the University of Trento and the SEU Institute of Perugia.
