L. Parcu, T. Brennan and V. Glass. Against the recent case law of the Court of Justice, the paper discusses, from both a legal and an economic perspective, the potential for a wider recourse to the compensation fund as a mechanism for USO financing and the related difficulties for its assessment and clearance under the applicable State aid rules.
