Alessandra Fratini publishes an article on the Dansk Automat Brancheforening judgement
Alessandra publishes an article in the European Gambling Law Journal LEXANDGAMING, which reviews the recent judgment of the General Court of the EU on the appeal against the Commission decision approving under State aid rules the proposed Danish law on gaming duties, which provided for a differentiated tax regime of online gaming compared to slots machines and amusement arcades (Case T-601/11, Dansk Automat Brancheforening v. Commission). The article looks at the Court’s application of the admissibility requirements under Article 263(4) TFEU in the context of the gambling sector and considers to what extent a land-based operators’ association may claim to be directly and individually concerned by newly introduced differentiated tax regime for online gambling.
