Blanca Salas and Bruno G. Simões publish an article on the European Commission’s infringement proceedings against the UK
The article, published in Issue 4/2014 of the European Journal of Risk Regulation, discusses the possible implications of the formal letter of notice that the European Commission addressed to the UK with regards to the latter’s ‘traffic light’ nutrition labelling scheme. The article describes the functioning of the scheme and examines key aspects that look poised to have a particular impact on the development of the infringement proceedings initiated by the Commission. In particular, the article analyses the scheme’s ‘voluntary’ character; whether certain elements thereof may constitute ‘non beneficial’ nutrition claims; and whether it may pose obstacles to the free movement of goods in the EU.
